1. Operator and Scope
TOW is operated by Malinda AI UG, Kirschbaumweg 28, 69251 Gaiberg, Germany. These Terms govern access to and use of the TOW websites, cloud services, accounts, hosted workspaces, support, and related online services.
2. Accounts and Workspaces
You are responsible for the accuracy of account information, the security of credentials, and all activity under your account or workspace. Organisation administrators may manage users, settings, data, integrations, and billing for their workspace.
3. Plans, Fees, and Self-Hosting
Cloud and self-hosted plans may include free and paid tiers. Paid fees are due according to the plan selected or the applicable order, invoice, or commercial agreement. Self-hosted use of the TOW software is governed by the applicable software license in addition to these Terms.
4. Customer Content
You keep ownership of the content, data, files, prompts, comments, tickets, documents, and other material you submit to TOW. You grant Malinda AI UG the limited rights needed to host, process, transmit, secure, display, back up, and support that content for the purpose of providing TOW.
5. Acceptable Use
You may not use TOW to violate laws, infringe rights, transmit malware, attack or disrupt systems, bypass access controls, scrape the service abusively, send spam, process unlawful content, or interfere with other users or the operation of TOW.
6. AI Features
TOW may include AI-assisted features that summarize, draft, classify, answer, or suggest changes using workspace context. AI output may be inaccurate or incomplete and should be reviewed before use. If you connect your own AI keys or enable managed AI endpoints, workspace content may be processed by the configured AI providers to deliver those features.
7. Third-Party Services
TOW may integrate with third-party providers for authentication, email, hosting, analytics, payments, AI processing, or imports. Those services may be subject to their own terms and privacy notices.
8. Service Changes and Availability
Malinda AI UG may improve, modify, suspend, or discontinue parts of TOW. The service is provided without a guaranteed uptime commitment unless a separate written agreement states otherwise.
9. Disclaimers and Liability
TOW is provided on an "as is" and "as available" basis to the maximum extent permitted by law. Malinda AI UG is not liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, lost data, or business interruption, except where liability cannot be excluded by law.
10. Termination
You may stop using TOW at any time. Malinda AI UG may suspend or terminate access if you breach these Terms, create security or legal risk, fail to pay applicable fees, or use TOW in a way that materially harms the service or others.
11. Governing Law and Contact
